Minor Liability, Assumption of Risk, and Parental Consent Waiver

1. A Traveling Farm — Minor Liability, Assumption of Risk, and Parental Consent Waiver Preamble This Minor Liability and Parental Consent Waiver ("Agreement") is entered into between the undersigned parent or legal guardian ("Parent/Guardian") and A Traveling Farm ("Provider"). The Parent/Guardian, on behalf of the minor named below ("Minor"), hereby acknowledges and agrees to the terms, representations, waivers and releases set forth below in consideration of the Minor's participation in any visit, program, activity, demonstration, appearance, mobile petting session, or other services or events (collectively, the "Services") provided by the Provider.

2. Acknowledgement of Nature of Activities and Assumption of Risk: The Parent/Guardian understands that the Services involve interaction with live animals and related agricultural equipment, enclosures, and activity areas. Such interactions include, but are not limited to, touching, feeding, holding, brushing, and being in close proximity to animals. The Parent/Guardian acknowledges that these activities are inherently risky and may result in personal injury, illness, allergic reaction, disease transfer (zoonoses), bites, scratches, kicks, falls, or other physical harm to the Minor. The Parent/Guardian voluntarily assumes all risks associated with the Minor’s participation in the Services, whether known or unknown, foreseeable or unforeseeable.

3. Health, Allergies and Special Needs: The Parent/Guardian certifies that they have fully and truthfully disclosed all known allergies, medical conditions, medications, behavioral issues, or other special needs of the Minor in the appropriate sections of this form. The Parent/Guardian understands that failure to disclose such information may increase the risk of harm and may limit the Provider’s ability to respond appropriately in the event of an emergency.

4. Supervision and Responsibilities of Parent/Guardian: The Parent/Guardian acknowledges that while Provider staff strive to supervise animal interactions and maintain safe conditions, the Parent/Guardian remains primarily responsible for the Minor’s supervision, conduct, and compliance with rules. The Parent/Guardian agrees to remain on-site when required by the Provider, to follow all instructions given by Provider staff, and to immediately remove the Minor from any activity if requested by Provider staff.

5. Consent to Emergency Medical Treatment: In the event of an injury or medical emergency involving the Minor, the Parent/Guardian authorizes Provider and its agents to obtain medical care for the Minor as deemed necessary. The Parent/Guardian authorizes any licensed medical personnel to provide treatment and transport to an appropriate medical facility. The Parent/Guardian agrees to be financially responsible for any medical care and related transportation expenses incurred on behalf of the Minor.

6. Release, Waiver of Liability and Covenant Not to Sue: To the fullest extent permitted by law, the Parent/Guardian, on behalf of the Minor and the Parent/Guardian’s heirs, assigns, personal representatives, and next of kin, hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Provider, its officers, directors, employees, volunteers, agents, contractors, affiliates, and representatives (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, losses, costs or expenses (including attorneys’ fees) arising out of or in any way connected with the Minor’s participation in the Services, including but not limited to claims arising from the negligence (active or passive) of the Released Parties, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.

7. Indemnification and Hold Harmless: The Parent/Guardian agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) brought by any third party arising out of or related to the Minor’s participation in the Services, or as a result of any breach by the Parent/Guardian of this Agreement

8. Photo/Video Release: The Parent/Guardian hereby grants Provider the irrevocable right and permission to photograph, videotape, record, and otherwise capture images and likenesses of the Minor during participation in the Services, and to use such media for promotional, educational, advertising, or other business purposes without compensation. If the Parent/Guardian does NOT consent to such use, they must indicate this refusal in the designated field on this form.

9. Rules of Conduct and Right to Remove: The Parent/Guardian agrees that the Minor will follow all rules and instructions provided by Provider staff. Provider reserves the right to dismiss or remove the Minor from any activity if the Minor’s behavior is, in Provider’s sole judgment, unsafe, disruptive, or harmful to people or animals. No refunds shall be provided for dismissal due to behavior or for failure to disclose pertinent health or behavioral information.

10. Insurance and Assumption of Financial Responsibility: The Parent/Guardian understands that Provider does not provide personal medical or liability insurance for participants. The Parent/Guardian is responsible for obtaining and maintaining any desired insurance. The Parent/Guardian agrees to pay for any property damage or animal harm caused by the Minor’s conduct.

11. Severability and Governing Law: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

12. Parent/Guardian Representation and Signature: The Parent/Guardian represents and warrants that they are the parent or legal guardian of the Minor, that they have the legal authority to execute this Agreement on behalf of the Minor, and that they have read, fully understand, and freely and voluntarily accept its terms. By signing below, the Parent/Guardian certifies that they have read this document in its entirety, understand its terms, and sign it voluntarily. The Parent/Guardian further acknowledges receipt of any Provider rules or informational materials provided prior to the Services.

13. SMS / Text Message Communications and Consent (TCPA & Florida FTSA)

By providing your mobile telephone number to A Traveling Farm — whether through a booking form, contact form, or any other means — you expressly consent, in writing, to receive text message (SMS/MMS) communications from A Traveling Farm at the number provided. These messages may include, but are not limited to: booking confirmations, event reminders, scheduling updates, and promotional or marketing messages regarding our services.

Message Frequency: Message frequency varies based on your interactions with us. You may receive up to 4 messages per month.

Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. A Traveling Farm is not responsible for any charges assessed by your wireless carrier.

Opt-Out / Unsubscribe: You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive one final confirmation message and no further marketing texts. To re-subscribe, reply START.

Consent Is Not a Condition of Purchase: You are not required to consent to receiving SMS/text messages as a condition of booking or purchasing any service from A Traveling Farm. Refusal to provide consent or withdrawal of consent will not affect your ability to book services.

Florida Residents — Florida Telephone Solicitation Act (FTSA), Fla. Stat. § 501.059: Florida law provides additional protections for consumers. By providing your telephone number and affirmatively submitting a booking or contact form on this website, you expressly agree, in writing, to receive automated or pre-recorded calls and text messages from A Traveling Farm. This written consent satisfies the requirements of the Florida Telephone Solicitation Act as amended effective July 1, 2021. You may revoke this consent at any time as described above.

14. Email Marketing — Mailchimp and CAN-SPAM Act Compliance

A Traveling Farm uses Mailchimp (operated by The Rocket Science Group, LLC) as its email marketing service provider. By submitting your email address through any form on this website, you may be subscribed to our mailing list to receive booking-related communications, event updates, seasonal promotions, and other news about our services.

Consent: We will only send you marketing emails if you have provided express consent. You may withdraw this consent at any time without penalty.

Unsubscribe: Every marketing email we send includes a clear and functional unsubscribe link. You may click that link at any time to be immediately removed from our mailing list. You may also request removal by emailing cw@atravelingfarm.com. Opt-out requests will be honored within 10 business days.

Data Shared with Mailchimp: When you subscribe to our email list, your name and email address are transferred to and stored on Mailchimp's servers. Mailchimp processes this data as our data processor under a Data Processing Agreement. Mailchimp's privacy practices are governed by Mailchimp's own Privacy Policy, available at mailchimp.com/legal/privacy.

CAN-SPAM Act (15 U.S.C. §§ 7701–7713): All commercial email messages we send comply with the federal CAN-SPAM Act. Our emails will: (a) clearly identify A Traveling Farm as the sender; (b) include our valid physical mailing address; (c) use accurate and non-deceptive subject lines and header information; (d) be clearly identified as advertising or promotional when applicable; and (e) include a functional opt-out mechanism that is honored promptly. We do not purchase, rent, or harvest email addresses.

15. Third-Party Communication Platforms

A Traveling Farm uses certain third-party platforms to deliver, manage, and track communications. These currently include, but may not be limited to: Mailchimp (email marketing), HubSpot (CRM and form submissions), and Google Analytics (website usage tracking). Each of these platforms operates under its own privacy and data processing policies. We have agreements in place with each provider to ensure your data is handled responsibly and in compliance with applicable law. We do not authorize these platforms to use your personal data for their own marketing purposes.

16. Electronic Communications Consent

By using this website, submitting any form, or otherwise communicating with A Traveling Farm electronically, you consent to receiving electronic communications from us in satisfaction of any legal requirement that such communications be in writing. This includes transactional emails, booking confirmations, notices, disclosures, and other information we may provide to you. You agree that all agreements, notices, and other communications delivered to you electronically satisfy any legal requirement that such communications be made in writing, to the fullest extent permitted by applicable law, including the Florida Electronic Signature Act, Fla. Stat. § 668.001 et seq., and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.

17. Contact Preferences and Right to Opt Out

You may manage your communication preferences with A Traveling Farm at any time using the following methods:

To stop SMS/text messages: Reply STOP to any message from us.
To stop marketing emails: Click the unsubscribe link in any email or email cw@atravelingfarm.com.
To request deletion of your data: Email cw@atravelingfarm.com with your request.
For all other preferences: Call us at 386-349-1852.

Please note that opting out of marketing communications does not remove you from transactional or service-related communications necessary to fulfill an active booking or contractual obligation. These Terms & Conditions were last updated March 2026.
